Support to Dealing with the Past Roadmap implementation in Nepal
Switzerland contributes to peace and stability in Nepal by addressing the root causes of the conflict. A Dealing with Past Roadmap ensures that actors and institutions fulfill their responsibilities towards the four pillars of Transitional Justice- truth, justice, reparations and non-recurrence. The conflict victims will participate in the process and benefit from the delivery of needed services within the federal state structure.

|Contexte||The historic Comprehensive Peace Agreement (CPA) provides the foundation for Nepal’s constitution and transitional justice (TJ) process. The lack of political will and technical guidance has delayed the conclusion of the peace process. The lack of accountability for the conflict has enabled a culture of impunity in Nepal. However, TJ remains an outstanding and pressing objective of the Nepali leadership. Based on a long-standing legacy and principled approach to development, Switzerland has been able to facilitate the dialogue among the parties on Dealing with the Past (DWP). Timely engagement in this political process will not only help further Switzerland’s international peace building objectives, but also promotes the legacy of Swiss good offices and ensures the continued success of the achievements Switzerland helped build in the past. There is understanding and acceptance for a new mechanism that brings together all stakeholders for the implementation of the peace process. The coordinated support of the international community is requested to provide impartiality and independence to Nepali-led and Nepali-managed victim centric Dealing with the Past process that complies with international standards and best practices.|

Output 1.1: Government of Nepal announces a joint political mechanism to deal with the past.
Output 1.2: The joint political mechanism drafts a roadmap that incorporates all four pillars of Transitional Justice.
Output 2.1: All victims from all 7 provinces constructively participate in the Transitional Justice process.
Output 2.2: Empowered CVs access services from the local government.
Output 3.1: Commissions and Office of the Attorney General have capacity to fulfill their mandates.
Output 3.2: International Development Partners’ Group members allocate sufficient resources to the joint trust fund.
Principaux résultats antérieurs: The first phase of this program started in 2019. During the last two years, despite the COVID-19 context and resurgence of political turmoil, the constant engagement of Switzerland has ensured that TJ remained a national priority. Switzerland engaged with the conflict victims and the political leadership by providing facilitation and sharing knowledge to help clarify concepts related to the holistic approach to DWP. These interventions have resulted in the creation of a common understanding on the holistic DWP approach among the stakeholders which have been reflected in important political documents. Likewise, there is acceptance for a mechanism to build consensus among all the parties. Another significant result of the last phase is that the conflict victims are claiming their space as primary interlocutors and actors in the process, and not just beneficiary. They have started to present themselves with a common voice and are clearly articulating their needs. In the last year, all the communications made by the conflict victims are joint statements signed by all the groups. The international community is also clear and coordinated in supporting the Nepali stakeholders in the TJ process. They have established a common position on engaging jointly with the primary stakeholders under the lead of the United Nations Resident Coordinator. The international community also agrees on future engagement through a reconciliation trust fund. However, due to new political conflicts, the political leaders have not taken ownership of the TJ process which has affected the institutions. The COVID-19 situation has hindered the investigation on the cases at the commissions and in the lack of the amendment of the TJ act, institutions related to TJ remain ineffective and thus, there were less engagements at the institutional level.

All the Swiss Cooperation Strategy programs as a cross cutting theme address roots causes such social and economic exclusion and implement Constitution, which is an outcome of the Comprehensive Peace Agreement.
Collaboration with National Human Rights Commission as an important actor. Coordination will be strengthened with the international donor partners through the Human Rights Core Group of the International Development Partners’ Group or Transitional Justice working group.
